Historic $104.6 Million Verdict Against Employer Secured by Pitt McGehee Palmer Bonanni & Rivers
We are proud to announce that Pitt McGehee Palmer Bonanni & Rivers’ Kevin Carlson and Robert Palmer, alongside New Mexico attorney Eric Sirotkin, have secured the largest employment-related verdict in New Mexico history, winning an unprecedented $104.6 million in a breach of contract case against Bright Green Corporation (BGC) on behalf of their client, John Fikany.
The case stems from an agreement between John Fikany and BGC founders John and Lynn Stockwell, when Fikany was hired as the CEO and, as part of his employment agreement, given five million shares of the company in exchange for advancing BGC’s interests. This included securing a key business deal with the Pueblo of Acoma. After Fikany successfully negotiated a lease with the Pueblo, the deal fell through due to additional demands from John Stockwell, and Fikany was terminated. Despite confirming Fikany’s ownership of his five million shares, BGC canceled the shares without his knowledge after his termination.
“I feel incredibly validated by the unanimous jury’s verdict. When I began working with Bright Green, I was excited for the opportunity to help people live longer and healthier lives. I was also looking forward to partnering with the Pueblo of Acoma in New Mexico. Although this turned out to be a six-year disheartening experience, I am extremely grateful for my incredible Trial Team,” said John Fikany. “Their ongoing collaboration, unwavering values, and advocacy and their tireless work ethic, made all the difference throughout this challenging journey. I hope this outcome provides reassurance to employees in similar situations. I am humbled by the great, honest people of Grants New Mexico, who had the courage to stand up for what is right and deliver justice."
Co-Founder Michael Pitt was also instrumental in the development of the case. The combined efforts of these long-time civil rights lawyers resulted in this landmark verdict that not only restores faith in the justice system but also sends a strong message to corporations about the importance of honoring commitments to employees.
