Cary McGehee Comments on Federal Ruling Affirming Inmates’ Right to be Free of Toxic Environmental Conditions in a Women’s Prison Mold Exposure Lawsuit

Cary McGehee, who is working with a team of attorneys pursuing equitable relief for the prisoners, recently spoke with Michigan Public’s Stateside about the ongoing lawsuit and a recent federal ruling.
A federal judge recently denied the state’s motion to dismiss, affirming that the right to be free from toxic environmental conditions is a clearly established constitutional right. The decision cites case law recognizing that prison officials must address mold and ensure adequate ventilation systems.
“We look forward to continuing the fight to ensure that these women are no longer subjected to conditions that threaten their well-being,” said McGehee.
The lawsuit alleges that officials were on notice of the hazardous conditions as far back as 2018, citing internal reports and documented medical issues among the women incarcerated there. The plaintiffs are seeking injunctive relief to improve health and safety, including a complete replacement of the facility’s ventilation system.
